Article 1 - Purpose

These terms and conditions govern sales by DALLY HOSPITALITY SARL (located at 5 Bis Rue Ouargha, Agdal – Rabat MOROCCO) of hotel services.

Article 2 - Prices

The prices of our products are indicated in MAD including all taxes (VAT and other taxes applicable on the day of the order), unless otherwise stated and excluding processing and shipping fees.

In case of an order to another country, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and amounts are not the responsibility of DALLY HOSPITALITY.

They will be your responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities.

All orders regardless of their origin are payable in MAD.

DALLY HOSPITALITY reserves the right to modify its prices at any time, but the product will be invoiced based on the rate in effect at the time of order validation and subject to availability.

Products remain the property of DALLY HOSPITALITY until full payment of the price.

Warning: as soon as you take physical possession of the ordered products, the risks of loss or damage to the products are transferred to you.

Article 3 - Orders

  • By phone at +212 537 67 39 67 (at the regular rate set by telephone operators in MAD incl. tax / min) Monday to Sunday from 9am to 6pm.

Contractual information is presented in French and will be confirmed at the latest at the time of order validation.

DALLY HOSPITALITY reserves the right not to register a payment and not to confirm an order for any reason whatsoever, and particularly in case of supply problems or difficulties with the order received.

Article 4 - Order Validation

Any order placed on the dallyhotel.com website implies acceptance of these General Terms and Conditions. Any order confirmation implies your full and complete acceptance of these general terms and conditions of sale, without exception or reservation.

All data provided and the recorded confirmation will serve as proof of the transaction.

You declare that you are fully aware of this.

The order confirmation will serve as signature and acceptance of the operations carried out.

A summary of the information in your order and these General Terms and Conditions will be sent to you in PDF format via the email address confirming your order.

Article 5 - Payment

Validating your order implies the obligation to pay the indicated price.

Payment for your purchases is made by credit card through the secure "PAYZONE" system.

The only payment cards accepted on the Site are: Visa and Mastercard.

Depending on the pricing conditions chosen, payment may be:

  • charged immediately at the time of booking (non-refundable or prepaid rate),
  • made upon arrival, according to the terms specified in the booking confirmation.

In some cases, a credit card imprint may be required as a guarantee at the time of booking or during check-in.

In case of no-show or late cancellation, the establishment reserves the right to charge the amounts provided in accordance with the applicable pricing conditions.

Article 6 - Withdrawal / Refund

In accordance with Article L.221-21 of the Consumer Code, the right of withdrawal does not apply to accommodation services, other than residential accommodation, provided on a specific date or according to a determined period.

Consequently, any reservation made with DALLY HOSPITALITY is firm and final, subject to the cancellation conditions specified at the time of booking.

Any cancellation or modification request must be made in writing (email) and will be processed according to the pricing conditions applicable at the time of booking.

In case of early departure, the full reserved stay remains due.

No refund may be claimed in case of no-show, late arrival, or early departure.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply in the following cases:

  • Accommodation services, other than residential accommodation, provided on a specific date or according to a determined period (hotel stays, nights, packages, special offers), once the reservation is confirmed for a specific date.
  • Service provisions fully performed before the end of the withdrawal period and whose execution began with the prior express consent of the customer and their express waiver of the right of withdrawal.
  • Personalized or custom services, including specific offers, packages, adapted stays, special requests, or personalized services at the customer's request.
  • Services whose price depends on market fluctuations beyond the control of the establishment (e.g., variable rates depending on the period, events, high demand).
  • Catering, breakfast, ancillary services, or experiences provided on a specific date (restaurant, room service, events, etc.).

Consequently, any confirmed reservation is firm and final, except for special conditions expressly provided at the time of booking (flexible rate, cancellable offer, specific promotional conditions).

Article 7 - Availability

Our products and services are offered as long as they are visible on the dallyhotel.com website and subject to available stock.

In case of product unavailability after placing your order, we will inform you by email. Your order will be automatically cancelled and no bank charge will be made.

Furthermore, the dallyhotel.com website is not intended to sell its products and services in large quantities. Therefore, dallyhotel.com reserves the right to refuse orders for which stock is not available.

Article 8 - Delivery

Reserved rooms and services are made available to the customer on the date and time indicated at the time of booking, in accordance with the conditions specified on the stay confirmation.

The check-in time is indicated in the booking information. In case of early arrival, access to the room cannot be guaranteed and remains subject to availability. In case of late arrival, the customer is invited to inform the establishment as soon as possible.

In case of a delay in making the room available attributable to the establishment, the establishment undertakes to inform the customer as soon as possible and to propose, if applicable, an appropriate alternative solution (room change, waiting, or other equivalent solution depending on availability).

In accordance with current regulations, if the reserved service cannot be provided on the agreed date for a reason attributable to the establishment, the customer may request the cancellation of their reservation and the refund of amounts paid, under the conditions provided by the Consumer Code.

In case of no-show on the scheduled date or unreported late arrival, the reservation may be cancelled by the establishment and the full stay will remain due, unless special conditions are provided at the time of booking.

Article 9 - Warranty

All our products and services benefit from the legal warranty of conformity and the warranty against hidden defects, provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product or service sold, it may be returned, exchanged, or refunded.

All claims, exchange, or refund requests must be made within 30 days of the service.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided in Article 6.

Article 10 - Liability

The products and services offered comply with current legislation. DALLY HOSPITALITY cannot be held liable in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you intend to order.

Furthermore, DALLY HOSPITALITY cannot be held responsible for damages resulting from misuse of the purchased product.

Finally, DALLY HOSPITALITY cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruption, external intrusion, or the presence of computer viruses.

Article 11 - Applicable Law in Case of Disputes

These general terms and conditions of sale are subject to Moroccan law. The language of this contract is French. The terms of sale corresponding to the offers proposed on this Site are subject to the consumer protection provisions applicable in Morocco. Any dispute must be subject to a prior attempt at amicable settlement. In the absence of an amicable settlement, only Moroccan courts (Rabat) will have jurisdiction to deal with the dispute.

Article 12 - Cancellation

You have the option to cancel your reservation before the start of the stay, subject to the pricing conditions chosen at the time of booking.

Any cancellation request received after the start of the stay or in case of no-show will be considered as a late cancellation and will result in full or partial billing of the stay, in accordance with the pricing conditions accepted at the time of booking.
